Transition

The Income-tax Act, 2025

The Income-tax Act, 2025 came into force on 1 April 2026 and governs income of FY 2026-27 onwards. The Income-tax Act, 1961 continues to apply to earlier years, including the return you are filing now for FY 2025-26, and to assessments, appeals and proceedings relating to those years.

In practice this means a period of dual compliance. The year you are dealing with decides which Act, which section numbering and which forms apply. Carried-forward losses and unabsorbed depreciation move across under specific transitional provisions, and reporting formats have been reissued under the new Rules.

We are tracking the transition across live engagements and will flag, in each file, which Act governs the year in question.

What has not changed. The obligation to disclose foreign assets and foreign income, the requirement to substantiate exchange rate conversion, the need for Form 67 to be filed in time, and the value of a reconciled working paper file are unaffected by the change of statute. A file built properly under the 1961 Act answers a query raised under the 2025 Act just as well.
