Questions

Compliance, answered

When is Form 15CB required for a foreign remittance?

Broadly, Part C of Form 15CA, supported by a certificate in Form 15CB from a chartered accountant, is required where the remittance is chargeable to tax in India and the aggregate of such remittances in the financial year exceeds ₹5 lakh. Part A applies below that threshold, and Part B where a certificate or order from the Assessing Officer under section 195(2), 195(3) or 197 has been obtained. Certain specified payments listed in Rule 37BB are exempt from the requirement altogether. The classification drives the withholding rate, so the treaty article and the nature of the payment should be settled first.

What are the consequences of a TDS default?

Interest under section 201(1A) runs at 1% per month for failure to deduct and 1.5% per month for failure to pay after deduction. A late filing fee under section 234E accrues at ₹200 per day until the statement is filed, capped at the amount of tax deductible. Disallowance of the related expenditure may follow under section 40(a)(i) or 40(a)(ia). Most defaults we see are traceable to the wrong section being applied to a payment, not to an intention to delay.

Foreign assets & notice

I had issues with my ITR filing and also received a notice regarding foreign assets declaration, which was quite stressful. I approached Mr. Mahendra, and he handled everything very professionally and efficiently. He carefully reviewed my already filed ITR, rectified the mistakes, and guided me step by step in correctly declaring the foreign assets. He is very knowledgeable, responsive and clear in his explanations, which gave me a lot of confidence and peace of mind throughout the process. Highly recommend him to anyone looking for reliable support for ITR filing, rectifications, or handling income tax notices.
